DEEP SEARCH AI: CLARITYCHECK – TERMS OF USE

1. INTRODUCTION

These Terms of Use (“Terms”) govern your access to and use of the DEEP SEARCH AI: CLARITYCHECK iOS application and related services (collectively, the “Services”), which enable users to run people and background‑style searches based on public information, perform reverse image lookups, and compare product prices using search engines and third‑party AI technologies.

By downloading, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

2. DEFINITIONS

“User”, “You”, or “Your” means the individual using the Services.

“DEEP SEARCH AI”, “DEEP SEARCH AI: CLARITYCHECK”, “CLARITYCHECK ”, “We”, “Us”, or “Our” refers to the operator of the Services.

“User Content” means text queries, names, images, and any other materials you submit or upload to the Services for search or analysis.

3. ELIGIBILITY AND AGE REQUIREMENTS

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use the Services.

If you are under 18 years old, you represent that you have permission from a parent or legal guardian to use the Services.

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected, we will delete it promptly.

4. NO ACCOUNT REGISTRATION

DEEP SEARCH AI does not require user account registration to use the core features of the Services.

You are responsible for maintaining control of your device and ensuring the security of your local data.

5. USER CONTENT AND RECORDING RESPONSIBILITY

5.1 Ownership

You retain ownership of all User Content you create or upload.

5.2 License to Operate the Service

By using the Services and submitting User Content, you grant DEEP SEARCH AI a worldwide, non-exclusive, royalty-free license to:

Process your queries and images
Forward them to third‑party AI and search providers
Display the results back to you in a structured way defined by the service provider
Operate and improve the Services

This license exists solely to provide the Services.

5.3 AI-Generated Content Disclaimer

Search results, summaries, matches, and other outputs may be generated or ranked using automated AI systems and external search engines

We do not guarantee:

Accuracy
Completeness
Reliability
Fitness for legal, medical, financial, or professional advice

You are responsible for reviewing AI-generated outputs before relying on them.

6. SUBSCRIPTIONS AND PAYMENTS

Certain features of the Services are available only through a paid, auto‑renewing subscription.

Payments are processed by Apple through your Apple ID.

Subscriptions automatically renew at the end of each billing period (for example, weekly) unless canceled at least 24 hours before the end of the current billing period.

You may manage or cancel subscriptions through your Apple account settings.

We do not process or store payment card information. Refunds are handled according to Apple’s policies.

7. THIRD-PARTY SERVICES

The Services rely on third-party providers, including:

AI processing providers, including AI processing providers (such as OpenAI, Gemini), web and image search engines like Google.
Subscription management providers
Apple payment processing

These third parties operate under their own terms and privacy policies. We are not responsible for third-party systems or service interruptions caused by them.

We use contractual and technical measures to require that they provide protection for your data that is at least equivalent to ours. We are not responsible for the availability, accuracy, or performance of third‑party systems.

8. PROHIBITED USE

You agree that you will not:

Use the Services for any unlawful, harmful, or fraudulent purpose.
Use the Services to stalk, harass, threaten, or intimidate any person, or to engage in doxxing or invasion of privacy.
Attempt to use the Services as a facial recognition or identity verification system or to make decisions that have legal or serious consequences for others (e.g., employment, housing, credit) without independent verification.
Upload, share, or search for content that is illegal, infringing, defamatory, or otherwise violates the rights of others.
Attempt to reverse engineer, disrupt, or interfere with the operation or security of the Services.

9. DATA STORAGE

User search query related contents is primarily stored locally on your device to temporarily process for providing AI functionality.

You may delete recordings and content within the application. Once permanently deleted, they cannot be recovered.

10. DISCLAIMER OF WARRANTIES

The Services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of AI-generated outputs

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, DEEP SEARCH AI shall not be liable for:

Indirect, incidental, or consequential damages
Loss of data
Business interruption
Reliance on AI-generated content
Unauthorized recordings by users

Our total liability shall not exceed the amount you paid for the Services in the preceding 12 months.

12. TERMINATION

We may suspend or terminate access if you violate these Terms.

You may stop using the Services at any time on your own will.

13. MODIFICATIONS TO TERMS

We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms.

14. GOVERNING LAW

These terms shall be governed by the laws of the country in which the user resides and the DEEP SEARCH AI app service provider country, without regard to conflict of law principles.
